Tagansky Court of Moscow on Friday, April 13, will begin to consider the merits of the statement of Roskomnadzor to block the envoy Telegram on the territory of Russia. This was reported by Interfax.
It also became known that in case of meeting its requirements Roskomnadzor asked the court to immediately block Telegram.
“This legal case is connected with the dissemination of information, and since Telegram does not provide the keys to decrypt messages, we are announcing an application for immediate execution of the decision, if the demand is satisfied,” said Roskommadzor.
For its part, Judge Yulia Smolina left the permission of the petition in question until the decision on the merits was made.
Meanwhile, according to “Vedomosti”, journalists Oleg Kashin and Alexander Plyushchev appealed to the European Court of Human Rights (ECHR) because of the blocking of the telegram’s telegram.
In their appeal, Kashin and Plyushchev indicated that the provisions of Russian legislation on the control of Internet correspondence violate their right to respect for private and family life, as well as the right to freedom of expression guaranteed by the Convention for the Protection of Human Rights
In turn, the lawyer of the organization “Roskomsvobodda” Sarkis Darbinyan said that in the near future in the ECHR will be sent complaints to 40 more users of Telegram.
Recall, on April 6 Roskomnadzor filed a lawsuit in the Tagansky court of Moscow on restricting access to information resources Telegram Messenger Limited Liability Partnership. The reason for the appeal to the court was the inability of the envoy to comply with the law, requiring the FSB to provide keys to decrypt the messages.
At the same time, Telegram’s lawyers said that the FSB’s demands to grant access to private correspondence of users are contrary to the Constitution, technically and legally impossible, therefore the requirement of blocking is also unreasonable.
